A Summary of Your Rights Under the FCRA

The federal Fair Credit Reporting Act (FCRA) promotes the accuracy, fairness, and privacy of information in the files of consumer reporting agencies. Here is a summary of your major rights under FCRA:

You have the right to receive a copy of your credit report.

You may request a free copy of your credit report once every 12 months from each of the three nationwide credit bureaus (Equifax, Experian, TransUnion) at AnnualCreditReport.com.

You have the right to dispute incomplete or inaccurate information.

Under FCRA Section 611, if you identify information in your file that is incomplete or inaccurate, you can dispute it with the credit bureau. The bureau must investigate within 30 days (Section 611(a)(1)).

Consumer reporting agencies must correct or delete inaccurate information.

If an item is found to be inaccurate or unverifiable after investigation, the credit bureau must remove it (Section 611(a)(5)).

You have the right to request your credit file disclosure.

Under Section 609, you can request that the credit bureau disclose all information in your file, including the sources of that information.

You can dispute directly with data furnishers.

Under Section 623, you can dispute information directly with the company that furnished the information to the credit bureau.

Outdated negative information must be removed.

Most negative information must be removed after 7 years (10 years for bankruptcies). Section 605.

You have the right to sue for violations.

Under Sections 616 and 617, you can sue a credit bureau or data furnisher in state or federal court for FCRA violations.
